Step 1: Visit the Canada Revenue Agency website, for an application form (T2050).
Step 2: Prepare the application form as prescribed.
Step 3: Submit the application to the Canada Revenue Agency, Charities Division, after receipt of the approved Letters Patent from the Companies Branch of the Ministry of Consumer and Business Services. The application must include:
- Cover Letter to indicate whom to contact.
- Photocopy of approved Letters Patent document.
- Charity Application Form with all accompanying documents.
Approval process: three to six month duration after receipt of completed application, prior to official acceptance. Changes may be requested. Time dependent on the complexity of the changes requested.
What if I am already incorporated as a not-for-profit? If you are already incorporated as a not-for-profit (without charitable objects and Special Provisions), you will have to re-apply to the Ministry of the Attorney General, Office of the Public Guardian and Trustee and/or to the Ministry of Consumer and Business Services, Companies Branch if provincially incorporated, to obtain Supplementary Letters Patent. You will have to re-apply to Industry Canada, if incorporated federally. Contact the Ministry of Consumer and Commercial Relations or Industry Canada for instructions and application procedures.
TIPS!
- By-laws are not required for new applicants.
- The Budget can be a projection of your annual activity. At this phase, you are not required to submit audited statements.
