A license agreement enables another party the right to reproduce, perform or publish a work.
An exclusive right licenses only one party (purchaser) to reproduce, perform or publish a work.
A non-exclusive right informs the purchaser that the license will not prevent the owner to license the work to other purchasers who may also reproduce, perform or publish the same work.
An agreement should include:
- The territory: worldwide or specific region(s)/country(s) where the work can be re-produced, performed or published.
- The term of the agreement, either in perpetuity or for a specific period of time.
- A license fee for the right to use the work, indicating the amount for each use and a payment schedule.
- A billing clause to identify how to credit the work and author, when and where credit is to be listed.
The purchasing party will agree to respect the original creation and will not make changes without the written permission of the owner.
